BLUON, INC. (“BLUON”) warrants to customers who have been trained by BLUON and have become Bluon Accredited1 by BLUON (the “Buyer”) who purchase the Product from BLUON, BLUON Approved Affiliates or BLUON Approved Distributors that the Product will be free from defects and manufactured in compliance with AHRI Standard 700, and when the Product is installed into an existing HVAC-R unit (as defined by a unique model#) in accordance with the specific conversion instructions provided by BLUON via their mobile app relevant to the unique model# and in accordance with any relevant OEM recommendations, guidelines or instructions BLUON warrants that for a period of: (i) One (1) Year from the date the Product is placed in a NEW and newly installed heating, ventilation, air conditioning, or refrigeration compressor(s); and (ii) Ninety (90) Days from the date the Product is placed in an already EXISTING and operational heating ventilation, air conditioning or refrigeration compressor(s) (each compressor referred to in (i) and (ii), a “Compressor”). If a component of a Compressor is found by BLUON to be damaged solely by the Product that is covered by this warranty, BLUON will reimburse Buyer or a Compressor owner who purchased the Product from Buyer (each being referred to in this paragraph as a “Claimant”) for the reasonable and customary Compressor costs only (as determined by BLUON in its sole discretion) incurred by the Claimant that is damaged as a direct result of the Product. For NEW Compressors, Claimant must first seek coverage under any Compressor (and/or component of such Compressor) warranty and present a written denial by said compressor manufacturer before any claim under this warranty will be honored.
This warranty only applies to Bluon Accredited Technicians that are in good standing with the Company and have completed all the necessary requirements to obtain Bluon Accreditation for Tier I (up to 20 tons) and Tier II (20+ tons). This warranty does not apply to any Product that has been (a) improperly stored, maintained, or used, (b) used under improper conditions, (c) used in violation of any BLUON’s published installation or maintenance guidelines and/or any applicable federal, state, or local statute, regulation or agency recommendation, (d) altered, or (e) damaged. This warranty does not apply to systems operating outside of OEM specifications or if there are free chemicals in the Compressor. This warranty does not apply to any Product that has been stored in a corrosive atmosphere, altered or whose serial number has been altered, defaced, or removed.
BLUON will not reimburse the Claimant if BLUON determines that the damage occurred as a result of normal wear and tear, liquid flood back, flooding, or flooded starts (refrigerant or oil related), operation of the Compressor under unusual conditions, operation or maintenance of the Compressor in a manner that does not conform to the manufacturer’s design intent or to industry standards. To seek authorization from BLUON, the Claimant must (1) notify BLUON Customer Warranty Service for a Warranty Claim Form within 7 days of damage; (2) submit the completed Warranty Claim Form by emailing it to [email protected] or fill out the appropriate form at bluonenergy.com/warranty within 30 days of damage. It is the Claimant’s responsibility to provide the evidence necessary for BLUON’s claim investigation, which will include some or all of the following: (a) maintenance records of equipment, (b) evidence of the OEM warranty denial or lack of coverage, (c) sample of the Product and damaged component(s) from the Compressor, (d) pictures of damage to semi-hermetic or open compressors, (e) hermetic compressor shipped to BLUON for evaluation, (f) sample of oil taken from compressor sump and/or system, (g) the refrigerant cylinder date code and/or cylinder number for the Product, (h) documentation of the date the Product was installed to include system readings at start-up or commissioning, (i) an itemized statement of the costs to be reimbursed. Claimant’s inability to provide an item listed above, that is requested by BLUON, will void the warranty.
BLUON WILL NOTIFY THE CLAIMANT OF WHETHER THE REPAIRS ARE AUTHORIZED FOR REIMBURSEMENT. BLUON WILL NOT REIMBURSE A CLAIMANT FOR ANY REPAIR, COST OR EXPENSE THAT IT HAS NOT AUTHORIZED FOR REIMBURSEMENT. EXCEPT AS STATED ABOVE, BLUON DISCLAIMS ALL EXPRESS WARRANTIES AND ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BLUON SHALL HAVE NO LIABILITY TO BUYER, AND/OR CLAIMANT, OR ANY PURCHASER FROM ANY CLAIMANT, FOR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, INCIDENTAL OR CONSEQUENTIAL DAMAGES. NO WARRANTY, EXPRESS, OR IMPLIED, IS EXTENDED TO ANY PERSON OTHER THAN A CLAIMANT. THIS WARRANTY IS NOT ASSIGNABLE, EXCEPT THE BUYER MAY ASSIGN THIS WARRANTY TO A MECHANIC WHO PURCHASES THE PRODUCT FOR REPLACEMENT IN A COMPRESSOR.
1 “Bluon Accredited” refers to an EPA 608 certified HVACR technician, whose certification is valid and current, and who has successfully completed the Bluon Accreditation Program.
